Rules of Procedure

for CLM and FAIFE

1. Council established two committees in 1997: the Copyright and other Legal Matters committee; and the Free Access to Information and Freedom of Expression (FAIFE) committee.

2. The terms of reference of the committees are:

2.1 CLM: The Committee advises the Federation and its constituent groups on:

  • Copyright and intellectual property
  • Economic and trade barriers to the acquisition of library and information materials
  • Disputed claims of ownership of library and information materials
  • Authenticity of electronic texts
  • Subscription and license agreements
  • Other legal matters of international significance to library and information services

2.2 FAIFE: FAIFE is an initiative within IFLA to defend and promote the basic human rights defined in Article 19 of the universal Declaration of Human Rights The FAIFE Committee and office further free access to information and freedom of expression in all aspects, directly or indirectly related to library and information services. FAIFE monitors the state of intellectual freedom within the library and information community worldwide, supports IFLA policy development and cooperation with other international human rights organisations, and responds to violations of free access to information and freedom of expression.

Chair

3. The Chair of each committee is appointed by the Governing Board. National Association Members which are not in arrears are eligible to nominate for these positions. Nominations, in response to a call for nominations issued by the Secretary General, have to be submitted by the announced deadline and accompanied by an indication of the nominee's experience and expertise in the subject area of the committee concerned, together with an indication of the support the nominee is likely to attract from their institution and/or association. Nominees should have consented to their nomination.

4. The term of office of the chair is two years, renewable once. 

Committee

5. Each committee consists of a maximum number of 27 members, excluding the chair.

Nominations

6. National Association members and Institutional members may nominate for places on each committee. Nominations, in response to a call for nominations issued by the Secretary General, must be submitted by the announced deadline on the nomination form issued with the call.

7. Only one nomination will normally be accepted from each National Association or Institutional Member.

Appointments

8. Members of each committee are appointed by the Governing Board, on the recommendation of the Chair, from the valid nominations received. The Board has adopted the policy of appointing only one member from any one country. In making the appointments, the Chair and the Board will take into account the need to ensure wide geographical representation on the committees

9. Members are urged to nominate only those who have significant interest and expertise in the issues within the terms of reference of the committee for which the nominee is being nominated. They should be able to report authoritatively on the state-of-the-art in their own country. They should also be able to act as advocates for the policies of IFLA in the field of interest of the committee concerned within their country.

Terms of office

10. The term of office for members of each committee shall be four years, renewable once.

11. Nominees should have reasonable expectation of being able to attend, without cost to IFLA, the four World Library and Information Congresses scheduled to take place in the four year period, in order to take part in the business and professional meetings of the committee. They should also be able contribute to the work of the committee in between congresses by email, telephone or fax.

Casual vacancies

12. In the event of the death or resignation of a member of these committees, the Chair may co-opt a person to fill the vacancy for the remaining term, subject to the criteria above. On completion of that term, the person concerned may be nominated for election to the committee for in the normal way. That person shall then be eligible to serve for one term only.

13. Any member of these committees who fails to attend two consecutive sets of meetings of the committee without reasonable explanation, or is otherwise inactive for a period of twelve months, shall be deemed to have resigned. The place thus vacated may be filled according to the provisions in rule 12.

Advisory Board

14. An Advisory Board for each committee shall be appointed by the Governing Board on the advice of the chair of the committee. It shall consist of no more than five members at least four of whom shall be drawn from the membership of the committee itself.

15. The Governing Board shall ensure that a member of the Governing Board is a member of each Advisory Board.

16. The terms of reference of the Advisory Boards are:
To act in an advisory capacity to determine priorities and to act as an advocate for the core activity to solicit financial support as necessary.

17. The terms of office of the Advisory Boards shall be four years, renewable once.

These Rules of Procedure were adopted by the Governing Board on 26 August 2006.

The Governing Board of IFLA decided at its meeting on 26 August 2006 in Seoul that the term of office will be 4 years (instead of 3 years) as from 2007. This will bring them in line with the terms of office of other IFLA bodies.
