Users’ Rights Cannot be Collateral Damage: IFLA Submits Comments on European Commission Guidance on Upload Filter Provisions of Copyright Directive

IFLA has submitted a response to a consultation by the European Commission on guidance to Member States on how to implement the controversial new provisions on internet platforms introduced by the 2019 Copyright Directive. In the face of efforts by rightholder organisations to wish away the protections offered for user rights – including the enjoyment of exceptions and limitations to copyright – IFLA has joined other groups working to safeguard these guarantees as part of a balanced overall regime. Anniversary of the EU-DSM directive!

The European Union Directive on Copyright in the Digital Single Market entered into force on 7 June 2019, with Member States having two years to transpose it (i.e. to implement it into national law). This directive aims to ensure better functioning of copyright rules across borders, allowing for a more integrated single market due to greater legal homogeneity across the bloc. Now, in June 2020, we are therefore at the mid-point of the implementation process. Countries still have one year to meet their commitments. Read More
